Naples Domestic Violence Injunction & Restraining Order Defense

Have you been served with a Temporary Injunction for Protection Against Domestic Violence in Collier County?

Under Florida law, once a temporary injunction is served, a final evidentiary hearing is typically scheduled within 15 days at the Collier County Courthouse. An injunction is not merely a restraining order—a final injunction permanently strips your Second Amendment firearm rights, forces you from your residence, creates a permanent public record, and exposes you to immediate felony arrest for accidental violations. Kristen E. Rodger provides aggressive representation to challenge unfounded, exaggerated, or tactically motivated petitions.

Injunction Actions Defended:

  • Domestic Violence Injunctions (F.S. § 741.30): Defending respondents against false allegations of violence or claims of imminent harm.
  • Dating Violence Injunctions (F.S. § 784.046): Protecting against petitions between dating partners lacking statutory grounds.
  • Repeat Violence & Stalking Injunctions (F.S. § 784.0485): Challenging claims involving digital harassment, cyberstalking, or neighbor disputes.
  • Injunction Violation Defense (F.S. § 741.31): Defending against alleged no-contact and distance order violations.

Strategic Hearing Defense:

  • Exposing Strategic Motives: Demonstrating when petitions are used as leverage in divorces, child custody disputes, or property battles.
  • Strict Rules of Evidence: Enforcing evidentiary rules to exclude hearsay, speculation, and unauthenticated digital evidence.
  • Cross-Examination: Impeaching the petitioner's testimony through timeline inconsistencies, text messages, and call logs.
  • Fifth Amendment Protection: Safeguarding your rights against self-incrimination when parallel criminal charges are possible.
